Bagaimana hukumnya dalam Islam apabila seorang suami meminum ASI dari istrinya sendiri?

Jawaban:

Syarat persusuan yang menciptakan orang yang menyusu menjadi anak sepersusuan ialah sebagai berikut:

1. Terjadi sebelum berusia dua tahun

Dari Ibnu Abbas RA, Rasulullah SAW, ”Tidak ada rodho’ (susuan) kecuali di antara usia dua tahun.” (HR. Daruquthni).

Orang atau anak yang menyusu kepada seorang ibu hanya akan menjadi anak sepersusuan apabila anak tersebut belum berusia 2 tahun. Jadi, meminum susu istri tidak menjadikannya mahram. Imam Malik menambahkan, masa sepersusuan itu menjadi dua tahun dua bulan. Imam Abu Hanifah menambahkan enam bulan menjadi dua tahun setengah untuk kehati-hatian.

2. Anak menyusu lima kali susuan

Aisyah RA berkata, “Dahulu dalam Al Quran

susuan yang sanggup mengakibatkan menjadi mahram ialah sepuluh kali penyusuan. Kemudian hal itu dinasakh (dihapus) dengan lima kali penyusuan saja. Lalu Rasulullah SAW wafat, dan ayat-ayat Al Alquran masih tetap dibaca menyerupai itu,” (HR Muslim).

Anak akan menjadi mahram apabila ia menyusu sebanyak lima susuan secara terpisah sebagaimana kebiasaan. Menurut Iman Syafi'i dan Hambali, isapan ketika anak menyusu harus mengenyangkan sehingga ia berhenti menyusu lantaran kenyang.

Abdullah bin Dinar berkata, “Ketika saya bersama Abdullah bin Umar di kantor pengadilan, ada seorang lelaki yang mendatanginya dan bertanya mengenai aturan menyusui orang dewasa. Abdullah bin Umar menjawab, ‘Suatu ketika ada seorang lelaki mendatangi Umar bin Khattab dan berkata; ‘Saya mempunyai seorang budak perempuan yang selalu saya gauli, kemudian istriku dengan sengaja menyusui budak perempuan tersebut. Maka ketika saya ingin menyetubuhi budak itu istriku berkata; ‘Jangan kamu lakukan, demi Allah saya telah menyusuinya’?” Lantas Umar berkata; ‘Hukumlah istrimu dan gaulilah budak perempuanmu, lantaran persusuan itu untuk yang masih kecil” (HR Malik).

Dengan demikian, air susu istri yang tertelan oleh suaminya tidak menjadikannya anak dari istrinya dan tidak pula kuat apa-apa terhadap ijab kabul mereka.
